1. Agreement to Terms

By accessing the Ultimate Termite website at ultimatetermite.com or engaging our inspection and pest control services, you agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree with any of these terms, you may not use our website or services.

2. Services

Ultimate Termite provides structural pest control inspections and treatment services in Southern California, operating under California Structural Pest Control Board License #PR7791. Our services include:

• Wood Destroying Organism (WDO) inspections
• Termite and pest control treatments (fumigation, orange oil, heat, spot, borate, liquid barrier, microwave, and electro-gun)
• Written inspection reports and treatment proposals
• Warranty and re-treatment services as specified in individual service agreements

All services are subject to the terms of the written service agreement provided at the time of each engagement. In the event of a conflict between these Terms of Service and a specific service agreement, the service agreement governs.

3. Inspections and Reports

Inspection reports are prepared in accordance with California Business and Professions Code and Structural Pest Control Board regulations. Reports reflect the observable conditions at the time of inspection only. Ultimate Termite is not responsible for:

• Conditions that were inaccessible, concealed, or not visible at the time of inspection.
• New infestations or damage that occurs after the inspection date.
• Third-party reliance on inspection reports beyond the intended parties disclosed in the report.

4. Warranties and Guarantees

Treatment warranties, if offered, are specified in writing in your individual service agreement and are subject to the terms, conditions, and exclusions stated therein. Warranties are non-transferable unless otherwise agreed in writing. Warranty coverage requires that the property owner provide reasonable access for any re-inspection or re-treatment and that the property be maintained in a manner that does not create new conditions conducive to infestation.

5. Payment Terms

Payment is due as specified in your service agreement. Returned payments may be subject to a returned payment fee. Accounts more than 30 days past due may be referred to collections and may accrue interest at the maximum rate permitted by California law. Ultimate Termite reserves the right to withhold warranty services on accounts with outstanding balances.

6. Cancellations and Rescheduling

Appointment cancellations or rescheduling requests must be made at least 24 hours in advance. Cancellations made less than 24 hours before a scheduled appointment may be subject to a cancellation fee as specified in your service agreement. Treatment cancellations after materials have been ordered or preparation has begun may be subject to restocking or preparation fees.

7. Customer Responsibilities

When receiving our services, you agree to:

• Provide accurate information about the property and any known pest activity.
• Ensure safe access to all areas of the property as reasonably requested.
• Follow all preparation instructions provided prior to treatment.
• Vacate the property and comply with all re-entry and safety instructions following fumigation or other treatments requiring evacuation.
• Notify us promptly of any adverse reactions or unexpected outcomes.

8. Limitation of Liability

To the maximum extent permitted by California law, Ultimate Termite's total liability for any claim arising from or related to our services shall not exceed the amount paid for the specific service giving rise to the claim. We are not liable for indirect, incidental, consequential, or punitive damages. Nothing in these terms limits liability for gross negligence, willful misconduct, or as otherwise required by law.

9. Website Use

You may use the Ultimate Termite website for lawful purposes only. You agree not to:

• Use the site in any way that violates applicable laws or regulations.
• Transmit any unsolicited commercial communications.
• Attempt to gain unauthorized access to any part of the site or its systems.
• Reproduce or redistribute any content from the site without written permission.

10. Intellectual Property

All content on this website — including text, graphics, logos, and images — is the property of Ultimate Termite or its content suppliers and is protected by applicable copyright and trademark laws. You may not use, copy, or distribute any site content without prior written permission.

11. Governing Law

These Terms of Service are governed by the laws of the State of California, without regard to conflict of law principles. Any disputes arising from these terms or our services shall be subject to the exclusive jurisdiction of the courts located in Orange County, California.

We reserve the right to modify these Terms of Service at any time. Changes will be posted on this page with an updated "Last updated" date. Continued use of our website or services after changes are posted constitutes your acceptance of the revised terms.
